Nairobi - A Nairobi court has declined to grant businesswoman Nancy Kigunzu alias Mathe Wa Ngara bail in a drug trafficking case.

Eugene Jumba denied bail

The businesswoman had applied to be released on bail after she was charged with trafficking drugs worth Sh18.3 million, Citizen Digital reported.

But in her ruling on Thursday, August 31, JKIA Law Courts Magistrate Njeri Thuku agreed with the prosecution's argument that Kizungu was a flight risk, given the circumstances under which she was arrested.

Magistrate Thuku denied Kigunzu's co-accused Eugene Jumba bail after terming him a flight risk given his involvement in drug trafficking.

According to the magistrate, granting the two suspects bond was not in the best interests of justice.

"Prosecution has placed strong, compelling reasons. It is not in the interest of justice to grant bond," the court said.

The businesswoman and Jumbo will remain in custody until the drug trafficking case is heard and decided.

Why did the court grant Teresia Wanjiru bail

However, the magistrate granted two of Kigunzu's co-accused persons a cash bail of KSh 50,000 each.

Teresia Wanjiru, initially mistaken to be Mathe Wa Ngara, was released on bail and ordered to provide contact information for two people, one of whom is a blood relative.

She was further ordered to appear before the JKIA law courts within seven days to file a social report.

Nany Kigunzu says she has a known residence

As reported earlier, Mathe wa Ngara asked the magistrate to grant her a bail release because she was ill.

Kigunzu, who collapsed on Monday, August 28, during the hearing of her bail application, told the court that her medical condition requires ongoing monitoring and medication and that she is concerned that if she is denied bail, it will worsen.

When she appeared before Magistrate Thuku, Kigunzu denied claims that she posed a flight risk and would skip court appearances.

Although she was detained in the Nairobi Central Business District, Kigunzu claimed, through her attorney, Danstan Omari, that her children were detained in a residential area, Citizen Digital reported.

However, the police were aware of her residence. She further denied assertions that she would interfere with witnesses by pointing out that they were police officers.
