Former Makueni MCA In Court For Threatening To Kill His Successor After Losing Petition

Nairobi - A former Makueni MCA has been charged with allegedly threatening to kill his successor after the 2022 General Election.

Denis Wambua Masavu, former Kisau/Kiteta Ward MCA, claimed his successor, Denis Kioko Mainga stole his victory.

Wambua filed a petition, and the case was dismissed, and he was ordered to pay Kioko KSh 1 million.

The prosecution told the court that Wambua allegedly threatened to kill Kioko on Saturday, March 11, in Ngoni village, Mbooni East district.

He reportedly accused the court of dismissing his petition after receiving a bribe, adding that he could not surrender; either Kioko died or him.

"My votes were stolen, and I went to Tawa Court but later realised that there was no court in Tawa, only money changes hands. Money was poured, and my case was thrown out. I cannot surrender. It’s either the current MCA dies, or I die. Because my votes cannot be stolen and then ordered to pay somebody one million. It’s not possible,” the prosecution said.

Wambua denies charges against him

Appearing before Chief Magistrate Susan Shitubi at the Milimani Law Courts, the former MCA denied the charges against him.

Wambua's lawyer asked the court to be considerate and grant him a lenient bond term because he was recovering after recently being released from the hospital.

"During the time of arrest, my client was returning from the hospital, he is under treatment for asthma and high blood pressure," the lawyer pleaded.

The prosecution did not oppose the request but asked the court to be strict on him upon release, arguing that he could interfere with the witnesses.

He was released on a bond of KSh 500,000 or a cash bail of KSh 200,000. He was also directed not to contact the complainant or witnesses as a condition for the bond.

The matter will be mentioned on Thursday, August 10, 2023, for pre-trial.

Uasin Gishu County Official threatens to kill magistrate

In a separate incident, Cosmas Kerich, a director of county enforcement, allegedly threatened to kill the then Principal Magistrate in charge of the court, Emily Kigen.

Kigen's lawyer Geoffrey Okara told the court trouble started after the magistrate responded to a call for help from a suspect from the municipal court cell.

Okara said releasing Kerich on bond would give him the freedom to continue harassing and threatening his client.
