Despite being acquitted of any wrongdoing, the youthful lawmaker said he would only consider himself victorious the time the DJ, who is bedridden, will be able to stand and walk with him.
"This judgement has gone the way God wanted it to go. I want to say the day I will be victorious is the day I will see DJ Evolve walk and stand by my side," he added.
Babu, flanked by his lawyers, disclosed his plans to fly the DJ to India for specialised medical treatment.
"I want to assure Felix and members of the public that I will walk by DJ Evolves' side and that I will always be there for him. In fact am planning to take him to India for further treatment. I pray God to grant Felix both physical and spiritual strength, to heal Felix and to ensure he walks in the near future," he stated.
Why the magistrate acquitted Babu Owino
Senior Principal Magistrate Bernard Ochoi said that the prosecution could not prove that the lawmaker was drunk and disorderly during the shooting incident.
Ochoi added that the prosecution failed to prove that the round that hit Evolve emanated from Babu's firearm.
"Having evaluated the evidence in court. I find that the prosecution has failed to prove the case beyond reasonable doubt," said the Magistrate
The magistrate observed that the case was of great public interest, but the investigations were shoddy, especially on exhibits, and no medical evidence proved that Babu's firearm injured Evolve.
"If the bullet head was recovered on the wall as claimed was it not necessary for a ballistic expert to visit the scene and adduce evidence, was it not necessary to provide medical evidence to show that the bullet exited from Evolve's body and landed on the wall?" posed the Magistrate.
